Welcome to Meatdryer! The terms “we”, “us” and “our” refer to Meatdryer. Meatdryer offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Our "Services" refer collectively to the Website (meatdryer.com) and our online store ecosystem, the Products (the Meatdryer smart hook hardware and accessories), the App (our mobile application for iOS and Android), and the Cloud Services (backend infrastructure, firmware, and data storage).

By visiting our site, purchasing a Product, downloading our App, or using our Cloud Services, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site and Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By accessing or using any part of the site or Services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
The Services are intended for personal, household use only. You are fully responsible for all activity that occurs under your account, including activity by household members. You agree to supervise all use of the Product and App by minors to ensure safety and compliance with these Terms.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

USER MANUAL ACKNOWLEDGMENT: By using the Product, you acknowledge and confirm that you have read the User Manual and all important safety instructions and user information contained therein. You agree not to operate the Product until you have done so.

SECTION 2 - PRODUCTS AND FIRMWARE
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
You acknowledge and agree that Meatdryer may automatically download and install firmware updates, security patches, and bug fixes to your Product without additional notice or consent. These updates may modify, add, or remove functionality. Updates will not negatively impact the core functionality of your Product except where strictly necessary to maintain security, compliance with law, or interoperability. These updates are necessary to maintain the security, compliance, and optimal functionality of the Product. Failure to install such updates (e.g., by permanently disconnecting the device) may void your warranty or expose you to security risks for which Meatdryer is not liable.

SECTION 3 - CLOUD SERVICES & AVAILABILITY
Included Service: Basic Cloud Services necessary for remote monitoring are currently provided on a complimentary basis at our discretion. We reserve the right to modify, suspend, or terminate these complimentary services or introduce subscription fees at any time upon reasonable notice.
Future Fees: While currently included, we reserve the right to change our fee structure or introduce subscription fees for any aspect of the Services at any time. We do not guarantee that the Cloud Services will be available indefinitely without cost.
Connectivity: Some of the Product features rely on Wi-Fi, cellular, and Internet connectivity. Failures in your network, cellular coverage, or internet service provider are outside our control.
Service Uptime: We do not guarantee that the Cloud Services will be available at all times. Service interruptions may occur due to maintenance, updates, or technical failures. We claim no liability for downtime or data loss.

SECTION 4 - ORDERS AND CONTRACT FORMATION
When you place an order, you are making an offer to purchase. Meatdryer reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Meatdryer confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Meatdryer may be unable to accommodate cancellation requests after an order is accepted. This operational limitation does not affect your statutory EU Right of Withdrawal. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
For the sale of physical goods, the contract of sale is formed only when we dispatch the Product to you. This distinction applies solely to the sale of goods; your use of the website, App, and Services remains subject to these Terms of Service immediately upon access.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Pre-Order Policy: By placing a preorder with Meatdryer you reserve your product(s) and have priority above all other orders that are placed afterward. You can cancel your preorder within 10 days of ordering if you decide to change your mind. To ensure you receive your product(s) as soon as they become available, your credit card or payment method will be charged once you place an order with a pre-order item. If you are placing an order with a pre-order item and a product that is in stock, your order will ship when the pre-order item is available. If a pre-order is significantly delayed beyond reasonable expectations, you are entitled to a full refund upon request.

SECTION 5 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. You are responsible for all applicable taxes.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 6 - SHIPPING, RETURNS, AND RIGHT OF WITHDRAWAL
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
Unclaimed Packages: If you fail to pick up your package or if delivery fails due to an incorrect address provided by you, the package will be returned to us. In such cases, we reserve the right to charge a fee (e.g., €15 or equivalent in local currency) to cover shipping and handling costs. This fee will be deducted from your refund.
Return Authorization (RMA): Do not send any Product back to us without first obtaining a Return Merchandise Authorization (RMA) number and instructions from our support team. Unsolicited returns or returns without an RMA number may be rejected or risk forfeiture.
Transport Damage: You must inspect the Product immediately upon receipt. If the Product is damaged during transport, you must report it to us within three (3) days of delivery with photographic evidence of the damage and both the inner and outer packaging. Failure to report within this timeframe or include packaging photos may result in the denial of your claim.
Promotional Bundles: If you return a Product that was purchased as part of a bundle or promotion (e.g., "Buy 3, Pay for 2" or "Free Gift with Purchase"), the discount is voided. The refund will be calculated by deducting the full regular price of the items you keep from the total amount paid.
EU Right of Withdrawal: If you are a consumer residing in the EU, you have the statutory right to withdraw from this contract within 14 days of receiving your goods without giving any reason. To exercise this right, you must inform us of your decision by a clear statement (e.g., via email to order@meatdryer.com) before the cancellation period expires. You must send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract. You will bear the direct cost of returning the goods. You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We reserve the right to deduct such value from your refund.
Hygiene Exception: THE RIGHT OF WITHDRAWAL DOES NOT APPLY TO PRODUCTS SEALED FOR HEALTH OR HYGIENE REASONS (SUCH AS THE MEATDRYER HOOK) IF THE SEAL HAS BEEN BROKEN BY YOU AFTER DELIVERY, IN ACCORDANCE WITH ARTICLE 16(1)(E) OF DIRECTIVE 2011/83/EU. DUE TO THE NATURE OF FOOD SAFETY TOOLS, WE CANNOT ACCEPT RETURNS OF USED OR UNSEALED HARDWARE.

SECTION 7 - FOOD SAFETY WARNING AND ASSUMPTION OF RISK (CRITICAL)
THE MEATDRYER PRODUCT AND APP ARE TOOLS DESIGNED TO ASSIST IN THE DRYING AND CURING PROCESS OF MEAT. YOU ARE SOLELY RESPONSIBLE FOR ENSURING FOOD SAFETY. CURING MEAT INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO BOTULISM, BACTERIAL GROWTH, AND SPOILAGE, WHICH CAN RESULT IN SEVERE ILLNESS OR DEATH.

ANY DATA, ESTIMATES, "DEGREE DAYS," PREDICTIONS, TEMPERATURE READINGS, HUMIDITY READINGS, OR STATUS INDICATORS PROVIDED BY THE PRODUCT OR APP ARE INDICATIVE RECOMMENDATIONS ONLY. THEY ARE NOT LABORATORY-GRADE MEASUREMENTS AND SHOULD NOT BE TREATED AS ABSOLUTE GUARANTEES OF SAFETY OR DONENESS. MEASUREMENTS MAY BE INACCURATE DUE TO SENSOR PLACEMENT, ENVIRONMENTAL FACTORS, BIOLOGICAL VARIATION IN THE MEAT, OR CONNECTIVITY ISSUES.

YOU MUST ALWAYS CROSS-REFERENCE PRODUCT DATA WITH YOUR OWN JUDGMENT, VISUAL INSPECTION, SMELL TESTS, AND ADHERENCE TO ESTABLISHED FOOD SAFETY GUIDELINES (SUCH AS THOSE FROM THE USDA, EFSA, OR YOUR LOCAL FOOD SAFETY AUTHORITY).

BY USING THE SERVICE, YOU EXPLICITLY WAIVE ANY CLAIMS AGAINST MEATDRYER REGARDING ILLNESS, HEALTH ISSUES, OR LOSS OF PRODUCT (MEAT/INGREDIENTS) RESULTING FROM THE USE OR RELIANCE ON OUR PRODUCT OR APP.

PHYSICAL SAFETY: YOU AGREE TO OPERATE THE PRODUCT STRICTLY IN ACCORDANCE WITH THE USER MANUAL. WE ARE NOT LIABLE FOR OVERHEATING, FIRES, SHORT CIRCUITS, OR MECHANICAL FAULTS CAUSED BY FAILURE TO FOLLOW AIRFLOW REQUIREMENTS, PLACEMENT INSTRUCTIONS, OR GENERAL CARE GUIDELINES.

SECTION 8 - INTELLECTUAL PROPERTY
License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes solely in connection with your use of the Product.
Our Services, including but not limited to the Product firmware, App software, all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Meatdryer, its affiliates or licensors and are protected by Swedish, U.S., EU, and foreign patent, copyright, trademark, trade secret, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Meatdryer, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Meatdryer.
Meatdryer’s names, logos, product and service names, designs, and slogans are trademarks of Meatdryer or its affiliates or licensors. You must not use such trademarks without the prior written permission of Meatdryer. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
Software Restrictions: You agree not to (a) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Product firmware or App; (b) modify, adapt, or create derivative works from the Product hardware or software; or (c) remove or alter any proprietary notices or labels on the Product or App.

SECTION 9 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 10 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 11 - RELATIONSHIP WITH SHOPIFY
Meatdryer is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Meatdryer. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Meatdryer, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Meatdryer.

SECTION 12 - PRIVACY POLICY & DATA STORAGE
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy at meatdryer.com/pages/privacy-policy for more details on how we, Shopify, and our partners use your personal information.
You acknowledge that your data may be stored and processed in servers located in the European Union (EU) and the United States (US). We reserve the right to change the location of data storage to other jurisdictions as our cloud infrastructure evolves, while maintaining compliance with applicable privacy and data transfer laws.

SECTION 13 - FEEDBACK AND USER SUBMISSIONS
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.
You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
User Content & IoT Data: You understand that by posting information or content on the Websites or otherwise providing content, materials or information to us or in connection with the Services, including, without limitation, information you have made available automatically through your use of the Product (collectively, 'User Submissions'). You retain full ownership of all User Submissions. However, by submitting them, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable and transferable right to fully exploit such User Submissions in connection with the Services.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 15 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Meatdryer, Shopify or users of the Services, or expose them to liability; or (j) to scrape, crawl, spider, or use automated systems to collect data or content from the Service.
Export Compliance: You agree not to export, re-export, or transfer the Product or Software to any country, person, or entity prohibited by applicable export control laws, including those of the EU, UK, and USA. You represent that you are not located in a country subject to comprehensive government sanctions.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext; or (e) interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 16 - SECURITY AND VULNERABILITY
We take security seriously and strive to comply with applicable cybersecurity and CE requirements.
Interference: You agree not to interfere with the security features of the Service.
Reporting: We maintain a Vulnerability Disclosure Policy which can be found at meatdryer.com/pages/security. If you discover a potential security vulnerability, you agree to report it to us in accordance with said policy rather than exploiting it or disclosing it publicly.

SECTION 17 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 18 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.
Limited Hardware Warranty: We warrant that the Meatdryer Product will be free from defects in materials and workmanship for a period of two (2) years for consumers residing in the European Union (or where required by local law), and one (1) year for consumers in all other jurisdictions. The warranty period begins on the date of original delivery to you. This warranty does not cover: (a) damage resulting from misuse, accident, dropping, or submersion in liquid beyond the Product's rated specifications; (b) damage caused by failure to follow the Product instructions; (c) normal wear and tear; (d) cosmetic damage; or (e) commercial use of the Product.
Your sole and exclusive remedy for breach of this warranty shall be, at our option, strictly limited to the repair or replacement of the Product.

Normal Operating Characteristics and Limitations: The following are expected characteristics of the Product and do not constitute defects or warranty claims:

Battery Performance: Battery life and total number of charges vary depending on usage, settings, environmental conditions, and temperature. The battery is a consumable component subject to normal degradation and may eventually need to be replaced. Battery replacement and reduced battery capacity over time are not covered under warranty.

Sensor Accuracy: The Product's temperature and humidity sensors are designed to be fit for purpose in meat curing applications but are not laboratory-grade instruments. Sensor readings may deviate from absolute accuracy and sensor performance may degrade over time with use. Sensors are calibrated for the intended use case and are not certified to professional or scientific standards. Sensor recalibration or degradation in accuracy is not covered under warranty unless caused by a manufacturing defect within the warranty period.

Operating Environment: The Product must be operated within the temperature and humidity ranges specified in the user manual. Use outside these specified ranges may affect measurement accuracy, device performance, and food safety outcomes, and may void your warranty.

Connectivity Requirements: Remote monitoring features require a stable 2.4 GHz Wi-Fi network connection and active internet service. Connectivity issues resulting from your network configuration, internet service provider, or incompatible router settings are not covered under warranty and are not the responsibility of Meatdryer.

App and System Requirements: The mobile application requires iOS 15.1 or Android 7.0 (or higher) with Bluetooth Low Energy (BLE) hardware support to function properly. Older devices without BLE support are not compatible. We do not guarantee compatibility with older operating systems, devices, or devices with limited screen sizes which may affect usability. The App is distributed through the Apple App Store and Google Play Store, and your use of the App is also subject to the applicable app store's terms and conditions. We are not responsible for app store policies, availability, removal, or restrictions.

EXCEPT AS EXPRESSLY STATED BY MEATDRYER, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

SECTION 19 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL MEATDRYER, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, gross negligence, or for any liability which cannot be limited under applicable consumer law.
Monetary Cap: NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY SHALL BE LIMITED TO THE GREATER OF (A) ONE HUNDRED EUROS (€100.00) OR (B) THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 20 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Meatdryer and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 21 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

SECTION 22 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 23 - ASSIGNMENT
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

SECTION 24 - GOVERNING LAW, VENUE & RECALLS
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Sweden.
Venue: Any dispute arising out of or in connection with these Terms shall be settled by the general courts of Sweden. In the event of a dispute that we cannot resolve directly, you may refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN) at www.arn.se. We participate in the dispute resolution procedure before ARN.
Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING LAWS IN THE US), YOU AND MEATDRYER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND MEATDRYER AGREE OTHERWISE, NO JUDGE OR COURT MAY CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. THIS CLAUSE DOES NOT LIMIT ANY RIGHTS YOU MAY HAVE UNDER MANDATORY CONSUMER PROTECTION LAWS IN YOUR COUNTRY OF RESIDENCE.
US State Law Rights: Certain U.S. states, such as California, require specific consumer disclosures. If you reside in such states, you may have additional rights that cannot be waived under these Terms.
Discard of Recalled Items: In the event of a product recall, you agree to immediately stop using the recalled Product. By completing a Recall Form or accepting a replacement, you agree that you have discarded or returned your affected items and they will no longer be in use. Meatdryer is not responsible for any damages or injury resulting from the continued use of recalled items.
